Contract: Once Keencut issues an order confirmation, a customer’s order becomes a contract, bound by these terms.
Delivery: Goods should be inspected on arrival. Any claim for damage in transit should be recorded on the proof of delivery and advised to Keencut within 24 hours.
Ownership of goods: Risk of loss or damage to the goods shall pass to the customer on delivery but ownership of the goods shall not pass to the customer until the customer has settled payment for the goods and all other goods supplied, in full. Prior to full payment the customer shall hold the goods for Keencut, ensuring they are stored safely and remain separately identifiable.
Returns Policy (consumer purchases): If your purchase from Keencut does not relate wholly or mainly to your trade, business craft or profession, you are entitled under the Consumer Contract Regulations to cancel your order within 14 days of receiving the goods. If you do this you must notify Keencut in advance (by email to [email protected]) and return the goods at your own expense. Once we have received the returned items in good condition we will issue a refund for the cost of the returned goods. Delivery costs will not be refunded.
Returns Policy (non-consumer purchases): If your purchase from Keencut relates wholly or mainly to your trade, business craft or profession, the Consumer Contract Regulations do not apply and no goods may be returned to Keencut without prior written approval.
Returns Policy (all): Keencut will not accept delivery of a product without a return reference number or if the freight is not prepaid. A product must be returned unused and undamaged in its original packaging to qualify for a refund, exchange or credit note
Payment: Please keep to your payment terms. Keencut reserves the right to charge interest on the overdue accounts at 4% per annum above the Bank of England’s base. If you fail to make payment on time, breach any of these terms or become insolvent, Keencut reserves the right to cancel this contract without notice.
Liability: Keencut’s total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, in relation to the supply of goods shall be limited to the order value.
Legal: These terms, which make up the entire agreement between the parties, shall be governed by the laws of England and Wales and the parties agree that the courts of England and Wales shall have exclusive jurisdiction over any matter arising from them. If there is any conflict between these terms and any terms imposed by the customer, these terms shall prevail. Nothing in these Terms excludes or limits Keencut’s liability for death or personal injury caused by its negligence; for any matter which it would be illegal for Keencut to exclude or attempt to exclude its liability; or for fraud or fraudulent misrepresentation. But if any part of this agreement is deemed unenforceable, it shall be severed from the remainder of the agreement which shall remain enforceable.
